新《矿产资源法》背景下矿区生态修复方案编制的思考与建议

Thoughts and Suggestions on Preparation of Ecological Restoration Scheme for Disturbed Mining Ecosystem in the Context of the Revised Mineral Resources Law

  • 摘要: 修订后的《中华人民共和国矿产资源法》于2025年7月1日起正式施行,将矿区生态修复纳入法律范畴,明确要求采矿权人在申请采矿许可证前编制矿区生态修复方案,且该方案为采矿许可证申请的必备要件,批准后需严格据此实施修复。本文梳理了不同时期矿区生态修复相关方案(土地复垦方案、矿山地质环境保护与治理恢复方案、矿山地质环境保护与土地复垦方案、矿区生态修复方案)编制的政策要求,对比分析了各时期矿区生态修复大纲的变化特征;结合《矿区生态修复方案编制指南》,逐章节提炼矿区生态修复方案的新增要求与核心编制要点,提出编制理念需实现从分项治理到系统修复、从静态规划到动态监管、从工程思维到生态思维的转变。在此基础上,从编制前、编制中、编制后三个阶段提出针对性建议:编制前强化培训,精准掌握相关法律法规与技术规范;编制过程中细化野外踏勘调查,精准诊断识别生态问题,注重新技术新方法应用与公众参与,提升附表附图质量;编制后准确把握方案定位,充分发挥其指导实践的核心作用,以期为矿区生态修复方案的科学编制提供理论借鉴与实践参考。

     

    Abstract: The revised Mineral Resources Law came into effect on July 1, 2025, thereby institutionalizing the ecological restoration of mining areas under the legal framework. Explicitly, it mandates that mining−right owner must prepare a mining area ecological restoration scheme as a prerequisite for mining license application, and such scheme shall be implemented in strict compliance with its approved contents. This study systematically sorts out the evolving policy requirements for the compilation of various mining area ecological restoration−related schemes (including land reclamation scheme, mine geological environment protection and governance scheme, mine geological environment protection and land reclamation scheme, and mining area ecological restoration scheme) across different periods, and conducts an in−depth comparative analysis of the shifts in their core outlines. Drawing on the guidelines for the preparation of mining area ecological restoration scheme, this article identifies the newly added requirements and key technical points chapter by chapter. It further proposes that the conceptual framework for scheme compilation should undergo three fundamental transformations: from isolated and piecemeal governance to holistic and systematic restoration, from static planning to dynamic and continuous supervision, and from an engineering−centric approach to an ecological systems thinking. Based on these insights, the article offers targeted recommendations for three key stages: pre−compilation, which emphasizes intensive training to ensure precise mastery of relevant laws, regulations, and technical specifications; during−compilation, which highlights refined field surveys and investigations to accurately diagnose and pinpoint ecological issues, the adoption of emerging technologies and methodologies, enhancement of public participation, and elevation of the quality of attached tables and drawings; and post−compilation, which underscores the accurate positioning of the scheme to fully leverage its guiding role in practical implementation. Collectively, this article aims to provide robust theoretical underpinnings and practical references for the scientific and standardized compilation of mining area ecological restoration scheme.
